1. Overview
Listifys encourages users to resolve disagreements directly and in good faith. When direct resolution fails, the Platform may offer structured dispute tools for eligible transactions.
1-1Parties to a Transaction Dispute
Most marketplace disputes are between a buyer and a seller. Listifys is not a party to peer-to-peer sales contracts except where we expressly provide payment protection, shipping labels, or similar services.
Claims against Listifys regarding Platform operation, account actions, or data handling are addressed separately in Section 8 of this policy and in our Terms of Service.
1-2Good-Faith Cooperation
All parties must respond promptly, provide truthful information, and upload relevant evidence when requested. Abuse of dispute tools, including false non-delivery claims or retaliatory reports, violates our Community Guidelines and may lead to enforcement action.
2. Resolving Buyer–Seller Disputes
2-1Step One: Direct Communication
Before opening a formal dispute, buyers and sellers should use Listifys messaging to clarify the issue, propose a remedy, and confirm any agreement in writing within the chat thread.
Many issues — including minor condition differences, delayed shipment, or missing accessories — can be resolved through partial refunds, replacements, or return shipping arrangements without Platform intervention.
2-2Step Two: In-App Dispute or Report
If direct communication fails, eligible buyers may open a transaction dispute from the order or conversation screen within the time limits shown at checkout or in the Buyer Policy.
Users may also report policy violations, fraud, harassment, or prohibited items through in-app reporting. Safety reports are reviewed under our Trust & Safety Policy and may proceed separately from payment disputes.
2-3Evidence to Provide
- Order confirmation, listing screenshots, and message history
- Photos or videos showing item condition on receipt
- Tracking information, delivery confirmations, or pickup records
- Payment receipts, refund offers, and return shipping proof
- Communications with carriers or payment providers, if relevant
3. Platform-Assisted Review
3-1Eligibility
Platform-assisted dispute review is available only for transactions that used Listifys payment protection or another covered checkout method identified at the time of purchase.
Off-platform payments, cash-at-pickup deals, and wire transfers outside Listifys checkout are not eligible for payment reversal by Listifys, though users may still report fraud or policy violations.
3-2Review Process
When a covered dispute is opened, we may place funds on temporary hold, request evidence from both parties, and apply the Buyer Policy, Seller Policy, and Refund & Cancellation Policy.
Listifys may make a determination based on the evidence available on the Platform. Our decision in covered payment disputes is final for purposes of releasing or refunding protected funds, without prejudice to either party's legal rights outside the Platform.
3-3Typical Outcomes
- Full refund to buyer when item not received and seller cannot prove shipment or handover
- Partial refund when item is materially misdescribed but retained by buyer
- Return and refund when return shipping is reasonable and buyer complies with return instructions
- Release of funds to seller when buyer claim is unsupported or filed outside allowed windows
- Account warnings or restrictions where misuse or fraud is identified
3-4Time Limits
Disputes must be opened within the window displayed for the transaction, typically within seven (7) days of confirmed delivery or within fourteen (14) days of expected delivery if tracking shows non-delivery.
Late claims may be accepted only where the buyer demonstrates that the seller concealed a defect, tracking was falsified, or exceptional circumstances prevented timely reporting.
4. Common Dispute Categories
4-1Non-Delivery and Shipping Delays
Buyers should verify tracking status and carrier delivery scans before claiming non-delivery. Sellers must provide valid proof of shipment for protected transactions.
Weather delays, customs holds, and carrier backlogs alone do not automatically entitle a buyer to a refund if the seller shipped within stated terms and tracking shows progress.
4-2Not as Described or Defective Items
Material differences in model, authenticity, functionality, or disclosed defects may support a refund or return. Subjective dissatisfaction, buyer's remorse, or minor cosmetic variance disclosed in listing photos may not.
For electronics and mechanical goods, buyers should document testing steps and serial numbers where applicable.
4-3Counterfeit and Prohibited Items
Claims involving counterfeit, stolen, unsafe, or prohibited goods are prioritized under our Prohibited Items Policy. Buyers should not return unlawful items through commercial carriers without legal guidance.
Listifys may require destruction, secure hold, or law-enforcement referral depending on item type and jurisdiction.
4-4Chargebacks and Payment Reversals
Initiating a credit-card chargeback while a Platform dispute is open may delay resolution and result in account restrictions. Users should pursue one primary resolution channel at a time unless required by their bank.
Listifys cooperates with payment networks and may submit transaction records in chargeback proceedings.
6. Optional Mediation
6-1Voluntary Mediation
For high-value or complex disputes where both parties agree, Listifys may suggest non-binding mediation through a neutral third party. Mediation fees, if any, are borne as agreed by the participants unless Listifys offers a promotional program.
6-2No Legal Advice
Listifys support agents and trust specialists do not provide legal advice. Users should consult qualified professionals for questions about court proceedings, statutory notices, or regulatory complaints.
7. Class and Representative Action Waiver (U.S. Users)
7-1Individual Claims
To the extent permitted by law, U.S. users agree that disputes against Listifys will be brought only in an individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding.
7-2Severability
If a court determines that the class-action waiver in this section is unenforceable for a particular claim, that claim may proceed in court while remaining disputes stay in arbitration as described in our Terms of Service.
8. Disputes With Listifys
8-1Informal Resolution First
Before filing arbitration or court action against Listifys, you must email contact@listifys.com with a concise description of the claim, requested relief, and account identifiers. We will attempt to resolve the matter informally within thirty (30) days.
8-2Arbitration and Governing Law (United States)
Except for qualifying small-claims matters and injunctive relief for intellectual-property misuse, disputes against Listifys arising from U.S. use are subject to binding arbitration and the U.S. governing-law and venue provisions in our Terms of Service.
The class-action waiver in Section 7 applies only to U.S. users and only where enforceable under applicable U.S. law.
