1-1Designated Agent
Our designated agent for DMCA notices is reachable at contact@listifys.com and at the mailing address listed in Section 10 of this policy.
1-2Non-U.S. Claims
Rights holders outside the United States may use the same contact channel. We evaluate non-U.S. copyright claims under applicable local law and our Copyright & Intellectual Property Policy.
2. DMCA Takedown Notice Requirements
2-1Required Elements
To be effective under the DMCA, a written notice must include all elements below. Incomplete notices may delay processing.
- Physical or electronic signature of a person authorized to act on behalf of the copyright owner
- Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered by a single notice
- Identification of the material claimed to be infringing and information reasonably sufficient to permit Listifys to locate it (listing URL, item ID, or screenshot with metadata)
- Contact information for the complaining party, including address, telephone number, and email
- A statement that the complaining party has a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
- A statement that the information in the notice is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the copyright owner
2-2How to Submit
Send notices to contact@listifys.com with the subject line "DMCA Takedown Notice." Mailing instructions appear in Section 10.
3. Notice Processing
3-1Review and Action
Upon receipt of a valid notice, we may remove or disable access to the identified material and notify the user who posted it.
3-2Incomplete Notices
We may request additional information before acting on notices that do not substantially comply with DMCA requirements.
3-3Good-Faith Belief
Submitting false infringement claims may expose complainants to liability under 17 U.S.C. § 512(f).
4. Counter-Notification Procedure
4-1When to Counter-Notify
If you believe your content was removed due to mistake or misidentification, you may submit a DMCA counter-notification to contact@listifys.com.
4-2Required Elements
A valid counter-notification must include:
- Your physical or electronic signature
- Identification of the material that was removed and its location before removal
- A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification
- Your name, address, telephone number, and consent to jurisdiction of the federal district court for your address or, if outside the U.S., any judicial district where Listifys may be found, and acceptance of service of process from the person who submitted the original notice or their agent
4-3Restoration Timeline
If we receive a valid counter-notification, we may forward it to the original complainant. Unless the complainant files a court action seeking to restrain the user within ten (10) to fourteen (14) business days, we may restore the removed content.
5. Repeat Infringer Policy
5-1Termination
In appropriate circumstances, Listifys terminates accounts of users determined to be repeat infringers.
5-2Strikes and Review
We maintain internal records of substantiated infringement claims and apply escalating enforcement, including permanent bans for persistent violations.
6. Safe Harbor and Limitations
6-1Hosting Status
Listifys qualifies as a service provider hosting user content at the direction of users. We do not monitor all uploads in advance.
6-2No Adjudication
DMCA processes address copyright removal and restoration. Ownership disputes not involving copyright or not meeting DMCA standards may require court resolution.
7. India and International Copyright
7-1India
Copyright complaints involving Indian works are handled under the Copyright Act, 1957 and Information Technology Act intermediary framework. Grievances may also be filed at contact@listifys.com.
7-2Other Jurisdictions
We honor valid copyright removal requests under EU Copyright Directive notice tools, UK copyright law, and comparable regimes where applicable.
8. Trademark and Non-DMCA Claims
8-1Trademark Notices
Trademark complaints that do not involve copyright should be sent to contact@listifys.com with clear identification of the mark, registration details if available, and the allegedly infringing listing.
8-2Policy Cross-Reference
Trademark enforcement may also proceed under our Copyright & Intellectual Property Policy and Prohibited Items Policy for counterfeit goods.
9. Privacy and Data Sharing
9-1Notice Forwarding
We may share DMCA notices and counter-notifications with affected users and complainants as required to fulfill DMCA procedures.
