1. Scope and Role of Listifys
Unless a listing states that shipping will be arranged by the buyer and seller, all shipping and delivery arrangements are made directly between buyers and sellers outside Listifys.
1-1No Carrier or Warehouse
Listifys does not operate as a courier, freight forwarder, warehouse, or delivery service. We do not take possession of items listed on the Platform, and we do not guarantee that any seller will ship an item or that any buyer will receive it.
References to "shipping," "delivery," or "dispatch" on the Platform describe actions that users may choose to perform independently or through third-party carriers they select.
1-2Intermediary Status
Listifys acts as an online intermediary under applicable law, including India's Information Technology Act, 2000 and IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, where relevant.
We provide tools for discovery, messaging, and optional payment facilitation. Logistics remain the responsibility of the transacting parties. Listifys does not currently provide or manage shipping, delivery, packaging, or carrier services.
1-3Supplemental Policies
This disclaimer supplements our Terms of Service, Buyer Policy, Seller Policy, Refund & Cancellation Policy, and Dispute Resolution Policy. Where shipping-related disputes arise, those policies govern alongside this document.
2. Fulfillment Models on Listifys
2-1Local Pickup and In-Person Handover
Many transactions on Listifys are completed through local pickup, curbside exchange, or in-person handover. Buyers and sellers should agree on a safe public meeting location, inspection timing, and payment method before meeting.
Listifys does not supervise in-person exchanges and is not responsible for personal safety, item condition at handover, or payment disputes arising after pickup.
2-2Seller-Arranged Shipping
When a seller offers shipping, the seller selects the carrier, packaging method, shipping cost allocation, and estimated timeline unless the listing states otherwise.
Sellers must accurately describe shipping terms in the listing, including whether shipping is included, charged separately, limited to certain regions, or unavailable for fragile, hazardous, or regulated items.
2-3Buyer-Arranged Shipping
In some categories or high-value transactions, buyers may arrange their own courier or freight service. The parties must confirm pickup address, packaging requirements, insurance, and customs documentation before dispatch.
Listifys is not liable for failed pickups, carrier delays, or damage occurring while goods are in transit under a buyer-selected carrier.
2-4No Platform Shipping Services
Listifys does not currently offer shipping labels, carrier booking, parcel tracking, packaging, or managed delivery through the Platform.
Any shipping or courier service buyers and sellers use is contracted directly with that third party. Listifys is not a party to those carrier contracts and does not warrant carrier performance.
3. Seller Shipping Obligations
3-1Accurate Listing Information
Sellers must disclose shipping availability, handling time, excluded territories, dimensional limits, and any special packaging needs before a buyer commits to purchase.
Misrepresenting shipping speed, cost, or eligibility may result in listing removal, refund obligations, negative feedback, or account enforcement under our Seller Policy.
3-2Dispatch Timelines
Unless otherwise agreed in writing between the parties, sellers should dispatch shippable items within the handling time stated in the listing or within five (5) business days after confirmed payment, whichever is shorter.
If dispatch will be delayed, sellers must promptly notify the buyer and provide a revised timeline. Repeated failure to ship may trigger cancellation rights and trust-and-safety review.
3-3Packaging and Labeling
Sellers are responsible for secure packaging suitable for the item's fragility, value, and mode of transport. Perishable, liquid, battery-powered, and hazardous goods require compliance with carrier and local law restrictions.
For cross-border shipments, sellers must provide accurate customs declarations and commercial invoices where required. Incorrect declarations may cause seizure, return charges, or legal liability borne by the seller.
3-4Proof of Shipment
Sellers should retain proof of dispatch, including carrier receipts, tracking numbers, photographs of packaged items, and weight measurements. Buyers may request reasonable proof when a shipment is disputed.
Where Listifys payment protection applies, failure to provide verifiable proof of shipment within a reasonable period may affect payout eligibility.
4. Buyer Responsibilities
4-1Delivery Address and Availability
Buyers must provide a complete, accurate delivery address and ensure someone is available to receive the shipment or authorize safe drop-off where permitted by the carrier.
Additional fees arising from address errors, refused delivery, or failed delivery attempts are generally the buyer's responsibility unless caused solely by seller mislabeling.
4-2Inspection on Receipt
Buyers should inspect packages promptly upon delivery. Visible carrier damage should be documented with photographs before opening, and the carrier should be notified according to its claims process.
For high-value or fragile items, buyers may request signature confirmation or insurance at checkout or before shipment, depending on seller options.
4-3Import Duties and Local Charges
International buyers are responsible for import duties, taxes, customs brokerage fees, quarantine charges, and any other levies imposed by destination authorities unless the listing explicitly states delivery duty paid (DDP) terms.
Refusal to pay lawful import charges does not automatically entitle a buyer to a refund from Listifys when the seller fulfilled the agreed shipping terms.
5. Domestic and Cross-Border Shipping
5-1India Domestic Shipments
For shipments within India, sellers and buyers should use reputable carriers and comply with applicable e-commerce, consumer protection, and goods-and-services tax requirements.
Cash-on-delivery arrangements, where used, are contractual between the parties and any participating carrier. Listifys does not guarantee COD collection or remittance unless expressly supported by a payment feature in that transaction.
5-2United States and Other International Routes
Cross-border shipping may be restricted for certain categories, including weapons, controlled substances, endangered species products, counterfeit goods, and items subject to export licensing.
Users must verify that an item may lawfully exit the origin country and enter the destination country before shipment. Listifys may remove listings or suspend accounts for unlawful cross-border trade.
5-3Sanctions and Denied Parties
Shipments must not be routed to sanctioned territories, denied parties, or end uses prohibited under U.S., Indian, UN, or other applicable sanctions and export-control regimes.
Listifys may block transactions or withhold features where shipping data indicates a sanctions or compliance risk.
6. Risk of Loss, Insurance, and Liability
6-1Transfer of Risk
Unless the parties agree otherwise, risk of loss or damage passes according to the shipping terms stated in the listing or message thread. If no terms are stated, risk generally passes to the buyer upon carrier acceptance of the parcel from the seller.
Listifys does not insure shipments unless a specific protection program is offered and accepted for that transaction.
6-2Carrier Liability
Claims for lost, stolen, or damaged parcels should be filed with the carrier in accordance with its policies and deadlines. Listifys is not a party to carrier contracts and cannot compel carrier claim outcomes.
Users should purchase declared-value coverage or third-party shipping insurance when item value exceeds the carrier's standard liability limits.
6-3Limitation of Listifys Liability
To the fullest extent permitted by law, Listifys disclaims liability for shipping delays, misdelivery, customs holds, weather disruptions, labor disputes, or any failure by users or carriers to perform logistics obligations.
Nothing in this policy limits non-waivable consumer rights under applicable law, including rights available to Indian consumers under the Consumer Protection Act, 2019 where relevant.
7. Delivery Issues and Remedies
7-1Non-Delivery and Significant Delay
If tracking shows no movement for an unreasonable period, or the buyer reports non-delivery after the stated delivery window, the buyer should contact the seller and open a dispute through the Platform where payment protection applies.
Remedies may include re-shipment, partial refund, full refund, or cancellation as described in our Refund & Cancellation Policy and Dispute Resolution Policy.
7-2Item Not as Described After Delivery
Shipping-related claims based on item condition, authenticity, or completeness are handled under buyer protection and dispute procedures, not as carrier delivery guarantees.
Buyers should report material discrepancies within the inspection window stated in the Buyer Policy or within forty-eight (48) hours of delivery for protected transactions if no shorter window is shown.
7-3Reporting Fraudulent Shipping Claims
Submitting fake tracking numbers, shipping to unrelated addresses, or falsely marking items as delivered may constitute fraud and result in account termination and referral to law enforcement.
Report suspected shipping fraud to contact@listifys.com or through in-app reporting tools.
